Policy & Shipping


Shipping

Please note all items are handmade in and ship from South Carolina, USA.
Items arriving within the USA will be sent using Priority Mail with tracking. 
Some larger orders may be send via UPS.
A Signature may be required for items over a certain value amount, please plan accordingly before ordering. 

We can never guarantee a delivery date only a shipping date. If in the event of damage in shipment please contact right away with photos of any issues for insurance purposes, do not discard the packaging.
If packaging is discarded a refund or replacement can not be processed as the insurance is void. If a package is Lost please first contact your housemates, neighbors and post office to see if the item has been misplaced. If it still can not be found and tracking shows 'delivered' you must contact the Police and file a stolen package report.
A copy of the police report must be emailed to us for insurance purposes.
It is the buyers responsibility to provide a safe, secure area for mail delivery. 


Non-US/International Shipping

Items outside of USA will be sent Standard International unless weight and value require Priority. Some packages may be sent via UPS depending on cost. Customs clearance fees, VAT/ GSP/ import charges and handling fees may apply if being delivered outside the the United States. These charges are imposed by the country the item is arriving into and the purchaser is expected to cover those fees. All buyers should know the laws, restrictions and import fees of their own country when purchasing internationally. Items that are refused or not picked up due to fees not being paid will not be refunded in full. Reship fees are the customers responsibility if item is to be sent back. 


We No longer ship to:
France, Germany, Portugal or the EU
due to new recycling fees and Import requirements.





POLICY

No returns or exchanges for custom sized or custom color items or made to order items. As each garment is made to order for each individual if there is an issue please message us to see what can be done, often a simple alteration is all that is needed. One free alteration is included for each item purchased within the USA, just let us know what needs to be done and the item will be adjusted and reshipped, via standard first class mail at no charge. Just cover the shipping to us. A fee and shipping costs will be incurred for any additional alterations or adjustments or for international shipments.


​Privacy
-Information I Collect To fulfill your order, you must provide me with certain information, such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order for example), if you contact me directly.

-Why I Need Your Information and How I Use It
I rely on a number of legal bases to collect, use, and share your information, including: as needed to provide my services, such as when I use your information to fulfill your order, to settle disputes, or to provide customer support; when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list; if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; 

-Information Sharing and Disclosure

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows: Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services. Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law. Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others. -Data Retention I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 7 years for tax purposes only.

-Transfers of Personal Information Outside the EU
I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified

-Your Rights
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below: Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below. Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request. Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons. Complain. Custom Sewing Policy 

I have taken every care to produce the highest quality product and your satisfaction is very important.  As most items are now custom made to order some minor variance from pictured items should be expected as some fabrics and notions are no longer available, if this is the case it will be noted in the listing. 

Due to the unique nature of each made to measure custom item, they are NON-REFUNDABLE. Turn around times can change dramatically between emailing me about an item and an order being placed. Please leave your event date in the notes when you check out so i can let you know if that date is possible. 

-Custom Design Policy and Exclusivity-
Items that are custom designed for a client ( no finalized sketch or picture is given during consultation) are the design property of Morningstar Pinup, any sketches, photos etc made by Morningstar Pinup may not be used by the client without permission. The completed design and artwork will not be considered exclusive to the client, unless the client has requested this and has provided their own unique fully finished original design requiring no design input from Morningstar Pinup. If the client would like to delay images of the final product being shared before their scheduled event just let me know before work begins. 

***If you would like a one of a kind design that will not be made available for sale to anyone else an ''exclusivity fee'' will apply***

-Deposits: 
All payments MUST be made through Pay Pal 
Please do not send payments directly to Paypal without purchasing a listing.
The clients deposit reserves my services and purchases and stores fabric for the item so that it would be guaranteed to be available when it is time to be completed.
The Deposit payment is NOT REFUNDABLE if you change your mind, your event is canceled, you decide to go in another direction or you don't make your final payment within 4 months unless other arrangements have been made ahead of time.  If an item is canceled no claim may be made to the fabric or any other items purchased for that order. If you decide you want a different fabric you must send your final payment for the order as well as pay for the additional yardage cost for new fabric. A Deposit amount is generally half of the total cost not including shipping but may be more or less depending on cost of materials for the chosen item.

-Paid In Full
If you have paid in full and it has been 2 days or less since your order date you may cancel for a full refund as long as no fabric has been ordered. 
If you have paid in full and no work has been done on your item, you may cancel the order only if the order has been open for less than 3 months. By canceling you forfeit a percentage as a deposit for your spot being held when other orders could have been accepted as well as the cost of materials that were custom ordered for you. The remaining amount will be refunded in the same form as your original payment. No claim to any fabric or materials that were purchased to fulfill that service may be made. It is the Buyers responsibility to check with me about arrival, sizing, materials etc to be sure of all details BEFORE an order is placed. 
If you have paid in full and work has begun. The item will be finished and mailed to you as previously planed.


*Orders That Cannot Be Completed*
Any orders lacking size/measurement/fabric/payment after 4 months will be canceled. Any and all payments will be considered a deposit and will be forfeited to cover time my wasted, loss of other possible income/customers and the cost materials purchased for the order. It is the buyers responsibility to promptly provide accurate information, to send payment when scheduled and to answer their messages in a timely fashion.

-ALTERATIONS & FIT ISSUES-

 *** It is the buyers responsibility to provide accurate measurements and fit information. Please do not order without first checking your body's actual measurements. My sizes may or may not line up with standard clothing sizes that you normally wear. Just because you wear a Medium most of the time does not mean you should order a Medium from me. A bra size is not the same as a 'Full Bust measurement'  bra size and full bust can vary up to 3'' from person to person. Check your actual body measurements and choose the size that best suits your body or just send me your measurements.***

-Brides
I Strongly recommend all Brides find a local tailor or seamstress they trust to fit them in person once their dress arrives so the best fit can be achieved for the big day. It is best to be able to show the seamstress or tailor what you would like adjusted and for them to see you in the dress to make recommendations. Even custom made dresses sometimes need a little adjustment when the person is not present during the creation of the item. There is no way for me to know how you want the dress to fit and feel when I cant fit you. Alterations should be expected so plan your arrival and your budget accordingly. Its not always needed but then its a happy surprise and not the other way around. I do not cover alterations costs done by others.

-Alterations US Locations Only-
If you have fit issues please message me to see if a simple modification is all that is needed, In most cases items can be altered. If you can tell me what the issue is i will let you know if it is something that can be done without having it fitted in person. Please contact me first so that i know to look for your item and so i know what needs to be done. I will alter an item up to 14 days after the item has been shipped.  Just send it back and ill fix it for you and at no extra charge except for any shipping fees back and forth.
In some cases it may be best that you have an item fitted by a tailor in your area, this should be expected with any online clothing ordering process, there is no guarantee that it will fit exactly the way you expect. With online custom sewing sometimes there are fitting issues because i cant see you in person and everyone is built a little differently even if they have the same measurements. I do not cover any alterations charges should it be altered elsewhere. 

-Materials-Color-Small Details
In some cases materials shown in images will no longer be available, the new fabric will be shown in listing or you will be sent a message regarding the change. Small items like trims, buttons, zippers, lace ruffles, buckles, etc may differ slightly due to what is available from suppliers at the time of your order, these minor differences may not be mentioned in listings and should be expected with custom non-mass produced items. Fabric type is described in the listing, i am not responsible for colors not matching items you already own, or how fabric may appear in photos vs in person. If you have questions regarding such issues they should be asked before purchase. Im more than happy to message pictures of the items that will be used for your item.
